हमारे देश मे हमेशा से ट्रांसजेंडर्स के लिए लोगो की मानसिकता अच्छी नही है, आम लोग हमेशा उन्हें उनसे अच्छे से ना बात करते है ना ही व्यवहार, इसी को देखते हुए हमारे देश की सरकार ने उन्हें भी सम्मान अधिकार दिया है, तो आइए जानते है इसके बारे में।

किसे कहते है ट्रांसजेंडर-

ट्रांसजेंडर उन्हें कहते है जिन की अभिव्यक्ति उस लिंग से अलग होती है जो उन्हें जन्म के समय दी गई होती है, ट्रांसजेंडर उन्हें कहा जाता हैं जो तीसरे लिंग के है, ट्रांसजेंडर शब्द का प्रयोग क्रॉस ड्रेसर को शामिल करने के लिए भी किया जाता है, अधिकतर लोग उन्हें हिजरा बोल के भी अपमानित करते है।

परन्तु अच्छी बात ये है की हमारे देश की न्यायपालिका तीसरे लिंग को मान्यता देती है, हमारे देश मे 15 अप्रैल 2014 को सुप्रीम कोर्ट ने तीसरे लिंग को मान्यता दी। उनका कहना था कि जो न तो पुरुष है ना ही महिला बल्कि तीसरा लिंग है उनकी भी अपनी पहचान होनी चाहिए, ये कोई सामाजिक या चिकत्सक मुद्दा नही बल्कि ये इंसानियत का मुद्दा है। आज हम आपको जोइता मंडल के बारे में जो कि हमारे देश की पहली ट्रांसजेंडर जज है, वो अपने समाज के लिए प्रेरणा है।

 

जोइता मंडल का परिचय-

हम सबको पता है की हमारे समाज ट्रांसजेंडर को वैसी इज्जत नही दी जाती जिसके वो हक़दार है, परन्तु जोइता ने जज बनकर उन सबकी धरणायो को गलत साबित किया है जो ट्रांसजेंडर को किसी काम का नही मानते है। जोइता 29 वर्ष की है, उन्हें 8 जुलाई 2017 को पश्चिम बंगाल के इस्लामपुर की लोग अदालत में जज के पद पर नियुक्त किया गया है।

हक के लिए सबसे लड़ी-

जोइता को बचपन से ही भेदभाव का सामाना करना पड़ा, उनके घरवाले भी उन्हें ही डांटते थे, स्कूल में भी सब उनका मजाक उड़ाते थे, इन सब चीज़ो से परेशान हो कर उन्होंने स्कूल जाना छोड़ दिया, ये साल 2009 की बात है जब उन्होंने अपना घर छोड़ दिया, जब वो कॉल सेंटर में नौकरी के लिए गयी तो उन्हें भी वहाँ वही सब झेलना पड़ा। कई बार तो उन्हें जिंदा रहने के लिए भीख तक मांगनी पड़ी, रहने के लिए कोई किराए का कमरा भी नही देता था, इसलिए मजबूरी में कई बार तो वो रास्ते पर ही सोई है। इन सब के बीच वो एक सामाजिक संस्था से जुड़ी और और सामाजिक कार्य के लिए अपना जीवन समर्पित कर दिया। 2010 से वो सामाजिक कार्यो में अपना योगदान दे रही है।

ट्रांसजेंडर को OBC केटेगरी का आरक्षण-

सुप्रीम कोर्ट ने ट्रांसजेंडर्स को सामाजिक और आर्थिक रूप से पिछड़ा मानते हुए, उन्हें शिक्षा और नौकरी दोनो में आरक्षण प्रदान किया जिससे कि उनका जीवन सवर जाए। जोइता कहती है कि मेरा लक्ष्य मेरे समाज के लोगो को जागरूक करना है ताकि को शिक्षित हो कर आत्मनिर्भर बन सके और बाकियों की तरह वो भी एक अच्छी और इज्जत वाली जिंदगी जी सके।

तीसरे लिंग से भेदभाव पर दंड का प्रवधान-

साल 2014 में 15 अप्रैल को सुप्रीम कोर्ट से एक बिल पास हुआ ट्रांसजेंडर्स वालो के लिए जिसमे लिखा है कि ट्रांसजेंडर्स के साथ अगर किसी ने भेदभाव किया या कोई अपराध तो उन्हें 6 महीने से 2 साल तक कि सजा होगी, साथ मे उन्हें जुर्माना भी देना पड़ेगा। ट्रांसजेंडर्स के साथ जिसने जैसा अपराध किया है उसके मुताबिक उन्हें दंड मिलेगा, इस बिल में ट्रांसजेंडर्स के लिए कॉउन्सिल नेशनल कॉउन्सिल फ़ॉर ट्रांसजेंडर पर्सन बनाने की बात कही गयी है, जो केंद्र सरकार को सलाह देगा।

केंद्रीय सामाजिक न्याय मंत्री इसके अध्यक्ष होंगे, और सोशल जस्टिस राज्य मंत्री इसके वाईस चेयरपर्सन होंगे, इसके साथ ही सोशल जस्टिस मंत्रालय के सचिव, हेल्थ, होमअफेयर्स, ह्यूमन रिसोर्स डेवलपमेंट से एक-एक प्रतिनिधि शामिल होंगे। नीति आयोग और नेशनल ह्यूमन राइट्स कमीशन के मेंबर्स भी इस कॉउन्सिल में होंगे, इसके साथ ही राज्य सरकारों का भी प्रतिनिधित्व होगा इसमें इसके साथ ही ट्रांसजेंडर्स कम्युनिटी के पांच सदस्य होंगे और अलग-अलग NGO के पांच एक्सपर्ट्स भी होंगे इस कॉउन्सिल में।

हम अपनी देश के सरकार ही सराहना करते है कि उन्होंने इतना नेक कदम उठाया, साथ ही सबसे निवेदन भी करते है कि ट्रांसजेंडर्स के लिए अपने मन मे उतना ही सम्मान रखें जितना कि दूसरे जेंडर्स के लिए आपके मन में है।
